Terms of Service

These Terms of Service (“Terms”) govern your use of the website pixel8production.com (the “Site”) and the video editing subscription services (the “Services”) provided by Pixel8 Production (“Pixel8,” “we,” “us,” or “our”).

By subscribing to our Services or using the Site, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or organisation, you represent that you have authority to bind that entity.

Pixel8 provides subscription-based video editing services, including but not limited to: YouTube video editing, short-form video editing, podcast video editing, product explainer video production, YouTube channel management, thumbnail design, motion graphics, and white-label editing services.

The specific deliverables, turnaround times, revision policy, and volume limits applicable to your subscription are defined in your plan agreement confirmed at onboarding.

To enable us to deliver Services effectively, you agree to:

• Provide raw footage, briefs, and materials within agreed timelines
• Hold the necessary rights to all footage, music, and assets you submit to us
• Provide timely feedback within the agreed review window (typically 48-72 hours)
• Ensure any materials submitted comply with applicable laws and do not infringe third-party rights
• Not submit materials that are unlawful, defamatory, obscene, or otherwise objectionable

Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the Services, and not to use such information for any purpose other than performing or receiving the Services.

This obligation of confidentiality does not apply to information that: (a) is or becomes publicly known through no breach of these Terms; (b) was already known to the receiving party; (c) is independently developed without use of confidential information; or (d) is required to be disclosed by law or court order.

For white-label clients, a separate mutual Non-Disclosure Agreement (NDA) governs the confidentiality of client relationships and third-party disclosures.

Standard turnaround times are 48 hours from brief submission for most deliverable types. Actual turnaround may vary based on video complexity, length, and current workload. We will notify you of any delays before your deadline.

All plans include unlimited revisions within the scope of the original brief. Requests that materially change the scope of the original brief (e.g., complete re-edit, new footage requirements, format changes) may require a new submission.

You may not use our Services to produce content that:

• Violates any applicable law or regulation
• Infringes the intellectual property rights of any third party
• Is defamatory, harassing, abusive, or discriminatory
• Promotes illegal activities, violence, or exploitation
• Contains sexually explicit material without prior written agreement
• Is designed to deceive, defraud, or mislead viewers

We reserve the right to refuse or terminate Services for content that violates these restrictions, without refund.

To the maximum extent permitted by applicable law, Pixel8's total liability to you for any claims arising from or related to the Services is limited to the amount you paid us in the 30 days preceding the claim.

We are not liable for any indirect, incidental, consequential, punitive, or special damages, including loss of profits, data, or business opportunity, even if we were advised of the possibility of such damages.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

We warrant that we will perform the Services with reasonable skill and care, and that deliverables will materially conform to your agreed brief.

Except as expressly stated above, the Services are provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement.

You agree to indemnify, defend, and hold harmless Pixel8 and its team members from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your violation of any third-party rights; or (c) your use of the Services in a manner not permitted by these Terms.

These Terms remain in effect for the duration of your subscription and continue to apply to any dispute arising from that period.

Either party may terminate the subscription at any time with written notice. We may terminate immediately for material breach, non-payment, or use of Services in violation of Section 8 (Prohibited Uses).

Upon termination, your access to delivery tools and shared assets ceases at the end of the billing period. We will make your final deliverables available for download for 30 days following termination.

These Terms are governed by applicable law. Any disputes arising under these Terms will first be attempted to be resolved through good-faith negotiation. If resolution is not reached within 30 days, disputes may be submitted to binding arbitration or the courts of the relevant jurisdiction, as agreed by the parties.

We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 30 days before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
